Dear Michael Gove,
I am writing to you, as a concerned member of the public, in reference to Save Our Rights UK’s Medical Freedom Bill campaign, which is supported by Lawyers for Liberty, UK Medical Freedom Alliance and the Workers for England Union.
The Medical Freedom Bill campaign is calling upon the Government to pass a new Bill to prevent:
- Mandation of medical procedures
- Introduction of vaccine passports or Covid-19 status certifications
- Coercion into consenting to medical procedures by way of withholding services and/or freedoms
- Discrimination against a person based upon their decision to partake in a medical procedure
This is an ongoing campaign that has become even more pertinent as you carry out a review of whether the Government should introduce or support vaccine passports or Covid-19 status certifications. Any such passport or certification, will create coercion to accept an Covid-19 test or experimental vaccine in order to enjoy basic freedoms, thereby preventing ones ability to give free and informed consent. It will also lead to discrimination and a medical apartheid developing in society between the vaccinated and the unvaccinated. This is profoundly illiberal and has no place in a free and democratic society such as the UK.
The conclusion of your review should be is clear – that the Government should not introduce either vaccine passports Covid-19 status ty certificates, and that these must be actively and vigorously opposedMany international laws and agreements enshrine the fundamental human right to medical freedom and bodily autonomy, and prohibit coerced or forced medical treatment by way of mandation, passports, certification or discrimination. They include:
- UN’s Universal Declaration of Human Rights
- Charter of Fundamental Rights of the European Union
- European Council’s Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine: Convention on Human Rights and Biomedicine
- European Charter of Patients’ Rights
- UN’s International Covenant on Civil and Political Rights
The UK is a signatory on all of these documents – details below:
The Charter of Fundamental Rights of the European Union states:
‘Everyone has the right to respect for his or her physical and mental integrity’.
The European Council’s Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine states clearly:
‘The interests and welfare of the human being shall prevail over the sole interest of society or science…’
‘…An intervention in the health field may only be carried out after the person concerned has given free and informed consent to it. This person shall beforehand be given appropriate information as to the purpose and nature of the intervention as well as on its consequences and risks. The person concerned may freely withdraw consent at any time.’
The European Charter of Patients’ Rights Article 4 Right to Consent states:
‘Every individual has the right of access to all information that might enable him or her to actively participate in the decisions regarding his or her health; this information is a prerequisite for any procedure and treatment, including the participation in scientific research’
Furthermore, I believe it is most succinctly laid out in UNESCO’s Universal Declaration on Bioethics and Human Rights (2005) Article 3 which states:
‘1. Human dignity, human rights and fundamental freedoms are to be fully respected.
2. The interests and welfare of the individual should have priority over the sole interest of science or society.’
And Article 6:
‘Any preventive, diagnostic and therapeutic medical intervention is only to be carried out with the prior, free and informed consent of the person concerned, based on adequate information. The consent should, where appropriate, be express and may be withdrawn by the person concerned at any time and for any reason without disadvantage or prejudice.’
In addition, The Parliamentary Assembly of the Council of Europe, to which the UK belongs, passed Resolution 2361 on 27 January 2021, Paragraph 7.3.1 and 7.3.2 in which it was stated that:
Ensure that citizens are informed that the vaccination is NOT mandatory and that no one is politically, socially, or otherwise pressured to get themselves vaccinated, if they do not wish to do so themselves.
Ensure that no one is discriminated against for not having been vaccinated, due to possible health risks or not wanting to be vaccinated.
This is not an exhaustive list of all relevant laws, declarations and statements, yet clearly demonstrates that any sort of mandation, passport, certification or discrimination (based upon testing, vaccination or any other medical procedure) is unlawful and cannot be supported, regardless of the efficacy of the procedure proposed.
It is clear that you must instruct the Government to not only oppose all vaccine passports or Covid-19 status certifications, but to also make it a criminal offence for private companies and businesses to introduce their own restrictions and versions of passports or certifications, due to the fact they would be unlawful, coercive and discriminatory.
After a difficult and damaging year of unprecedented and draconian restrictions, which have removed so many of our rights and freedoms in the name of Covid-19, it is disproportionate and unnecessary to go down the route of further restrictions and loss of freedoms that a vaccine passport/certification would entail. These measures would permanently increase state powers over the lives of UK citizens,making the basic human freedoms of movement and association conditional on accepting whatever vaccine or medical treatment the Government deems necessary at any given time.
The UK is standing at a crossroads where all that we stand for – Freedom, Human Rights and Democracy – could be sacrificed forever for the false illusion of safety. Your unique position allows you to stand up for every British citizen’s Rights and Freedoms to be protected and upheld for future generations to enjoy. Please urge the UK Government to pass a Medical Freedom Bill to protect its citizens’ fundamental rights, and to lead Europe and the rest of the world away from authoritarianism and back to individual responsibility and freedom.
